Failure to produce a specimen

Anyone who either refuses to or is unable to provide a breath / blood or urine sample when requested to by a police officer may be liable for an offence. This is unless they have a reasonable excuse for not doing so.

The ban imposed for this offence is that same as the 12 months minimum for drink driving, however magistrates will normally look to give a ban of 18 to 24 months unless good mitigation is shown.
